The laws providing for (i) public participation in respect of the drawing up of certain plans and programmes, (ii) integrated pollution prevention and control, (iii) environmental impact assessment, and (iv) administrative procedure are underachieved and limited to the strict minimum necessary to comply with the International and EU Law (Rio Declaration 1992, Aarhus Convention and Directive 2003/35/EC). The environmental governance instruments are none but classical participation processes based on the right of the public concerned to express comments and opinions. The National Parks Act of 2014 features a range of unambitious participation instruments but misregards, among others, the co-management of natural resources sponsored by the IUCN. Such a conformist legal framework is nevertheless in accordance with the unripeness of social activism on environmental matters, as statistics show.El trabajo analiza exhaustivamente el marco regulador español de la participación del público en la protección ambiental y en particular, en la protección de los espacios naturales. El resultado de la investigación apunta a una cierta atonía de las leyes de participación en materia ambiental, autorización ambiental integrada, evaluación ambiental y de procedimiento administrativo, todas ellas ceñidas a los mínimos estrictamente marcados por el Derecho internacional y de la UE (Declaración de Río, Convenio de Aarhus y Directiva 2003/35/CE). Los instrumentos para la «gobernanza medioambiental» se reducen a los clásicos trámites de «información pública» y «consultas a personas interesadas»), y la Ley de Parques Nacionales de 2014 incorpora mecanismos participativos poco ambiciosos, sin contemplar, por ejemplo, la cogestión de espacios naturales protegidos propuesta por la UICN hace décadas.
