In this sense, we will emphasize the reasons that determined the unfairness declaration of the expense term -that was not its generality-; the subject obligated to pay notary fees and its eventual equitable distribution; the scope of the Notary's preventive control; as well as the effects of the unfairness declaration by a single judgment of the Spanish Supreme Court in Plenary - understanding that it integrates the legal system (art. 1.6 Spanish Civil Code)-, and the inscription of that term in the Registry of General Terms and Conditions, concluding that these expense terms should not be authorized by notaries.En este artículo analizaremos cuál debe ser la actuación del notariado tras la STS de 23 de diciembre de 2015, que declaró nula por abusiva la cláusula del préstamo hipotecario que repercutía al consumidor todos los gastos de constitución del mismo –incluidos los notariales-, cláusula que ya consta inscrita en el RCGC.
