The goal is to demonstrate that the informed consent doesn’t directly constitute a fundamental right in both juridical systems analyzed and that the informed consent protects, essentially, freedom and self-determination in health.El presente artículo es una revisión bibliográfica de las doctrina y jurisprudencia acerca de la naturaleza jurídica del consentimiento informado y su respectivo encuadre en el selecto rol de los derechos fundamentales, a través del estudio comparativo de los modelos brasileño y español de protección al paciente.
