Summary: This paper aims to analyze the indigenous property rights in Brazil. Throughout the three parts of this paper, it was the intention of this work to study the definition of the ethnic identity criteria and self-determination for the identification of indigenous peoples, as well, to do a brief analysis of the possible models for the protection, compensation or reparation of the violation of indigenous property rights. To conclude, considering the analysis of ethnic identity and findings regarding indigenous property, this paper had the objective to apply the concepts presented, to the peoples of the Guarani Kaiowá ethnic group, in order to verify the Brazilian legislative and judicial behavior in relation to these communities, when the issue under discussion is the protection (or violation) of indigenous property rights.
