Summary: From the demand side perspective, public sector activities have a large potential as an instrument able to promote innovation. Public procurement can affect the innovation capacity of enterprises which supply public sector. Public procurement can also be used as a regional development instrument. However, the ability of public procurement as an innovation tool could be triggered by the normative and institutional framework of each country or region in which these activities take place. Therefore, the different institutional levels which affect and determine the public procurement of innovation should be distinguished, as well as the legislation associated with each of them. The main aim of this paper is to approach to the current legal framework which entails an important impact on public procurement of innovation, focusing on the analysis of the limitations and opportunities that the existing regulation could imply.
