The proposal is to study the growing performance of judicial power, particularly of the Supreme Court, within what is called judicial activism. The research in question, using a qualitative methodology of analysis and using the hypothetical-deductive approach of descriptive and analytical character, will examine specific cases determined by the Brazilian judicial power and its implications in the Brazilian political-institutional arrangement, pondering about the legitimacy of judicial activism.Este texto tem como objetivo analisar o atual papel do poder judiciário na estrutura dos poderes da República Federativa do Brasil. A proposta é analisar a crescente atuação do poder judiciário, em especial do Supremo Tribunal Federal, dentro do que se convencionou chamar de ativismo judicial. A pesquisa em tela, utilizando uma metodologia de análise qualitativa e usando abordagem hipotético-dedutivos de caráter descritivo e analítico, analisará casos concretos decididos pelo poder judiciário brasileiro e suas implicações no arranjo político-institucional brasileiro, ponderando sobre a legitimidade do ativismo judicial.Este texto tiene como objetivo analizar el rol actual del poder judiciario en la estructura de los poderes de la República Federativa de Brasil. La propuesta es estudiar la creciente actuación del poder judiciario, en especial del Supremo Tribunal Federal, dentro de lo que se llama activismo judicial.
