The public force is part of the constitutional structure of the State. This article is intended to address the constitutional model of this public organization from its general and particular characterization; for this purpose, there were reviewed, described and analyzed the constitutional and legal rules which govern it, as well as the relevant case law of the Constitutional Court in the matter. As a result, the similarities and differences between military forces and the national police became evident, as well as the factual and legal thresholds lapping, missionary tasks related to the use of force, and jurisprudential, administrative and legal measures aimed to preserve the constitutional model of this public organization. Research leads to the conclusion that the constituent modeled the public force and especially its mission, as an instrument to fulfill the purposes of the State, and mainly, to maintain the constitutional order and protect and ensure the rights and freedom of all residents in Colombia.

Este artigo pretende abordar o modelo constitucional desta organização pública a partir de sua caracterização geral e particular; para tal efeito, foram revisadas, descritas e analisadas as normas constitucionais e legais que a regem, bem como a jurisprudência relevante da Corte Constitucional sobre a matéria. Como resultados foram evidenciadas as semelhanças e diferenças entre as forças militares e a Policia Nacional, os limites fáticos e jurídicos que sobrepõem, as tarefas missionárias relacionadas com o uso da força e as medidas jurídicas, administrativas e jurisprudenciais, tendentes a preservar o modelo constitucional desta organização pública. A pesquisa permite concluir que o constituinte moldou a força pública e em especial sua missão, como instrumento para cumprir os fins do Estado e, principalmente, para manter a ordem constitucional e proteger e garantir os direitos e liberdades de todos os residentes na Colômbia. La fuerza pública forma parte de la estructura constitucional del Estado. Este artículo pretende abordar el modelo constitucional de esta organización pública a partir de su caracterización general y particular; para el efecto, se revisaron, describieron y analizaron las normas constitucionales y legales que la rigen, así como la jurisprudencia relevante de la Corte Constitucional en la materia. Como resultados, se evidenciaron las semejanzas y diferencias entre las fuerzas militares y la Policía Nacional, los umbrales fácticos y jurídicos que traslapan, las tareas misionales relacionadas con el uso de la fuerza y las medidas jurídicas, administrativas y jurisprudenciales, tendientes a preservar el modelo constitucional de esta organización pública.
