In the Moroccan system, the legal protection of the child depends on the legitimacy
of the filiation. It is mainly the parents’ Muslim marriage that allows establishing the recognition
of the filiation (sons of al firach), but there are other ways of establishing a filiation such as: the
recognition of paternity (Istilhak in arts. 160 to 162 of the Moroccan Family code MFC); Sexual
relations by mistake (shubha in art. 155 MFC); Children whose parents were not able to have
their marriage recognized or who entered into unions abroad in accordance with a local Law (art.
16 MFC) and for whom the Moroccan Government just extended the deadline for recognition
procedures; Children born from official engagements.
To resolve the problems concerning children born from extramarital relationships, we will demonstrate
how these two last recognition proceedings offer solutions to establishing the Spanish Moroccan filiation.
However, it is important to assess the “perverse” effects contained in them

C’est principalement le mariage musulman des parents qui permet d’établir la reconnaissance de la filiation (hijos al firach), mais il existe également d’autres modes d’établissements de celle-ci : la reconnaisance de la paternité ( istilhak de los arts. 160 a 162 CFM; les relations sexuales par erreur (subha contemplada en el art. 155 CFM ; les enfants issus d’unions entre parents qui n’ont pas pu faire reconnaître leur mariage ou lorsque ces unions ont été contractées à l’étranger selon la loi locale (art. 16 CFM) ; et pour lesquelles le gouvernement marocain vient de prolonger le délai afin de réaliser ce type d’actions, l’enfant nés de fiançailles reconnues. Pour résoudre les problèmes relatifs aux enfants issus de relations extra-conjugales, nous démontrerons comment ces deux derniers modes d’établissement offrent des solutions pour pouvoir établir la filiation hispano-marocaine, mais il faudra toutefois évaluer les effets « pervers », que celles-ci contiennentEn el sistema marroquí, la protección jurídica del hijo depende del carácter legítimo de la filiación. Ciertamente, el cauce principal para determinarla es el matrimonio musulmán de los padres (hijos al firach), aunque existen otras vías: el reconocimiento de la paternidad (istilhak de los arts. 160 a 162 CFM; las relaciones sexuales mantenidas por error (subha contemplada en el art. 155 CFM); los nacidos de uniones entre los progenitores que no pudieron validar sus matrimonios o cuando dichos enlaces fueron contraídos en el extranjero según la ley local (art. 16 CFM), para los cuales que el Gobierno marroquí acaba de prorrogar el plazo para realizar este tipo de acciones; el hijo nacido de noviazgo oficial (art. 165 CFM).
