The legal tools of EU immigration policies do not build a common and binding legal status. On the contrary, increasingly they used to build what we call “anomic spaces” (Durkheim, Merton). Thus, appear situations so-called “legal limbo”, “infra-law” or “no-law” cases. The law builds a notion of migrants characterized by a permanent state of emergency, whose characteristics are insecurity and precariousness. Thus confirming the thesis of the “reserve army of labour” (Marx), updated today by Sassen, Baumann, Lochak and Agamben. |
