The study presents a synthetic analysis of the evolution of the Spanish legislation on public works with the aim to identify the typical elements of each period.
Departing from the first legislation of the 19th century, the elements that give continuity
to the sector are explained. First, the organic aspects provided by the Ministry of Public
Works and the body of Civil Engineers. Second, the establishment of a liberal regime
for expropriation and its changes. Third, the material regulation in the «Restoration»
period which, despite the difficulties, survived until the democracy, without prejudice to
the new – and questionable – approaches to strategic planning and financing of public
works. Finally, in the recent democratic stage, we can seen also the presence, in the Law
of the public works, of new public interests related to the urbanism and the protection
of the environment. |
