The author criticizes capital punishment, tortures to the accused and concludes that prevention should be the final objective of punishment.La obra de César Beccaria De los delitos y las penas constituye un pilar para el Derecho Penal contemporáneo porque sustenta las principales ideas del liberalismo penal que, posteriormente al siglo XVIII, se manifiestan en el pensamiento penal occidental. Beccaria constituye uno de los abanderados que desde la filosofía y el Derecho penal desmontan el sistema inquisitivo de enjuiciar, propio del Derecho canónico de la época, para un sistema que incorporara mayores garantías para el procesado.
