Following the recent discovery of the volume by A. Koiève entitled The Notion of Authority – whose existence was previously known from a footnote in Esquisse d’une phénoménologie du droit – this article reviews the notion of authority using a phenomenological approach. The author starts from a conceptual analysis of the theories of authority by distinguishing 4 “simple‟ or “pure‟ categories (some analogues of the weberian types): – the theological or theocratic theory, according to which the only and primary authority belongs to God, all the others descending from it; – the Platonic theory, centred on Justice; – the Aristotelian theory, according to which the authority belongs to those who know and are able to foresee; – the Hegelian theory, which reduces the notion of authority to the relationship between sir and servant, thereby putting the emphasis on struggle and the recognition of a winner. According to Kojève, only the latter category “has received a complete philosophical elaboration, one that goes beyond a simple phenomenological description and uses metaphysical and ontological analyses.” However, the radical narrowness of man – on which Kojève basis its atheism and rejects the link between authority and transcendence – does not completely hides, according to the author of the article, traces of an anthropology where infinity appears again.

Kojève (di cui prima si conosceva l’esistenza solo grazie a una nota presente nell’Esquisse d’une phénoménologie du droit), recentemente rinvenuto. L’autore inizia col fare un’analisi concettuale delle teorie dell’autorità, distinguendo così quattro tipi “semplici” o “puri” (analoghi agli idealtipi weberiani): la teoria teologica o teocratica, secondo la quale l’Autorità primaria e assoluta appartiene a Dio, e tutte le altre ne derivano; la teoria platonica, secondo cui l’Autorità si fonda sulla Giustizia; quella aristotelica, secondo cui appartiene a chi ha il sapere e la capacità di prevedere; infine quella di Hegel che la riduce al rapporto tra Signore e servo (vincitore e vinto), basato sulla lotta, il rischio e il riconoscimento del vincitore come autorità. Di queste, solo l’ultima – scrive Kojève – “ha avuto un’elaborazione filosofica completa, che si sviluppa sia sul piano della descrizione fenomenologica sia su quello dell’analisi metafisica e ontologica, le altre non hanno oltrepassato il livello della fenomenologia”. La radicale finitudine dell’uomo, sulla quale Kojève in definitiva fonda la sua pretesa ateistica e cerca conseguentemente di svincolare dalla trascendenza ogni fondazione dell'autorità, non esclude, però, a parere di chi scrive, la traccia di un ‟antropologia in cui torna ad affacciarsi l’infinito”. A partir de un análisis fenomenológico, el artículo tiene por objetivo hacer una reflexión crítica sobre el desarrollo iusfilosófica de la noción de autoridad, siguiendo el ejemplo del libro “El concepto de Autoridad” de A. Kojève (del que primero se conocía sólo la existencia de una nota presente en “Esquisse d’une phénoménologie du droit”), recientemente descubierto. El autor comienza con un análisis conceptual de las teorías de la autoridad, distinguiendo así cuatro tipos: “simple” o “puro” (similar a los tipos ideales de Weber): la teoría teológica o teocrática, según la cual la primera y absoluta autoridad pertenece, a Dios, de la cual derivan todas las demás; la teoría platónica, según el cual la Autoridad se funda sobre la justicia; la teoría aristotélica, que la pone en quienes tienen el conocimiento y la capacidad de predecir; finalmente la teoría de Hegel, que reduce la relación entre Señor y siervo (ganador y ganado), basado en la lucha, el riesgo y el reconocimiento del ganador como autoridad. De éstos, sólo la última teoría —escribe Kojève— «tiene una elaboración filosófica completa, que se desarrolla tanto desde el plano fenomenológico, como del análisis metafísico y ontológico, mientras los demás no han pasado del nivel fenomenológico».
