Summary: Transitional justice mechanism known as the States with internal armed conflicts which enables reparation for victims of massive human rights violations caused by groups outside the law. This article assesses how the kidnapping is a crime that tests the scope of transitional justice in their effectiveness. To do this, a documentary analysis of the case law and international standards so as to enable national context this type of crime in Colombia is made. Among the most significant finds little harmonization between international and national instruments are highlighted. It was concluded that transitional justice has low effectiveness against the capacity to provide regulations to victims of kidnapping guarantees.
