Con tal propósito el trabajo se divide en siete partes: 1. La educación en la etapa indiana. 2. La educación bajo los primeros regímenes constitucionales del Chile independiente. 3. La educación y la libertad de enseñanza en las constituciones de 1828 y 1833. 4. El derecho a la educación y la libertad de enseñanza según la Carta de 1925. 5. La forma en que fueron recogidos ambos derechos en la Constitución de 1980. 6. El marco legal. 7. La búsqueda de equilibrios.
