On the contrary, if the judicial review action is considered as a concrete (as applied) examination, the Court’s powers would be increased in a way that the same legal rule can be considered as adjusting the Constitution in some cases, and contradicting constitutional norms in others, depending on judicial interpretation. Since this question must be addressed in the preliminary admissibility examination, and that the concrete review model gives the Constitutional Court powers that belong to non-constitutional ordinary judges, it must be concluded that constitutional justices should only review the statutory rules using an abstract examinationEl presente artículo tiene por objeto precisar cuál es la competencia del Tribunal Constitucional para conocer del recurso de inaplicabilidad. Si se estableciera que a este corresponde resolver en abstracto, el ámbito de sus atribuciones se reduciría considerablemente, limitándose a contrastar el precepto legal objetado con las normas constitucionales. A la inversa, si dicha apreciación debe hacerse en concreto, se amplían las referidas atribuciones a tal extremo que un mismo precepto legal puede ajustarse en ciertos casos a la Carta Fundamental y en otros contradecirla, dependiendo de la interpretación que en uno y otro caso se acuerde.
