The characters, when they meet the characteristics of originality and expression, should be considered as protected works. The specific characteristics of this character will be those that distinguish him from any other work. There are several types of characters among others: fictional, symbolic and human characterization. The latter requires an actor performance in order to be perceived by the public. However, it it may happen that the actor who plays the character adds originality with his performance, becoming in some cases coauthor of the character, or even giving life to a new character, hence, he, creates a new work. This article analyzes the characters of human characterization in terms of protectable work, its characteristics, the process of authorship, copyright and any rights that could have an actor who perform the character. |
