Summary: Federal electoral crimes in Mexico have evolved little in the last years. They have not gone hand in hand with electoral legislation; thus, the article presents an analysis with the aim of reflecting on this mismatch which has led to lack of efficiency, evidencing the need to update the legislation in order to face the national reality and respect the citizen’s right to the suffrage. It is structured into seven parts and it presents penal law and the definition of electoral crimes; the background of electoral penal law and the electoral crimes in the Federal Penal Code of Mexico. It also presents a comparative study of electoral crimes and the sanctions concerning electoral issues in five Latin American countries
