So, the hypothesis mentions that the state entities established creates negative incentives. The analysis conducts a multidisciplinary perspective with legal, organizational and, administrative techniques. The results demonstrate partial conclusions in the sense that the state autonomous entities have introduced flexibility but, the establishment of the same personnel within two different public entities has created problems related to command, rank and, responsibilities.La descentralización ha sido una de las políticas públicas de mayor peso para crear un nuevo federalismo en México. El estudio organizacional del sector salud en el estado de Querétaro permite apreciar los efectos de esta política. En particular, este proceso obligó a los estados a la creación de un organismo paraestatal para recibir las nuevas competencias. Por tanto, la hipótesis consiste en que dicha obligación ha creado incentivos negativos. Al efecto se realiza un estudio multidisciplinario mediante análisis jurídico, organizacional y administrativo.
