Thus, there are not always clear answers about the status of those rights whose ownership depends on the gender allocated to each person; for example, the rights arising from family relationships. In this context, based on the study of a recent Italian court decision, a critical analysis is conducted on the effects of ‘sex change’ inan existing marriage, with particular regard to current regulations and some mention of the Colombian model in order to determine whether the paradigm of heterosexual marriage persists.Si bien los ordenamientos jurídicos regulan el llamado ‘cambio de sexo’, poco dicen respecto de los efectos jurídicos en el ámbito de los derechos personales. Por ello no siempre existen respuestas claras acerca del estado de ciertos derechos cuya titularidad depende del género atribuido a cada persona; por ejemplo, los derechos derivados de las relaciones familiares.
