Com a elaboração do presente artigo procuramos analisar questões pertinentes ao exercício da liberdade de expressão, instrumento absolutamente necessário ao pleno exercício da cidadania, e direito fundamental consagrado pela Constituição Federal, como manifestação própria e típica de um estado democrático de direito, bem como as ofensas à honra objetiva dos Chefes do Poder Executivo, de modo a buscar estabelecer uma linha demarcatória até onde se estende a conduta autorizada e amparada constitucionalmente, a ponto de se afastar a tipicidade material de uma falsa imputação, e a partir da qual estaremos diante de uma conduta criminosa com capacidade para gerar responsabilização penal. Quanto aos aspectos metodológicos empregados, utilizamos a pesquisa teórica, realizada através de análise de conteúdo de doutrina, legislação e jurisprudência, envolvendo revisão bibliográfica e pesquisa documental. Procuramos desenvolver um raciocínio dedutivo, para, fixadas as premissas gerais, alcançar-se, via procedimento lógico-dedutivo, as conclusões obtidas ao final do trabalho.Palavras-chave: liberdade de expressão; direito fundamental; honra; calúnia.ABSTRACTThrough the preparation of the present article, we intend to analyze issues concerning the exercise of freedom of expression – an instrument that is absolutely necessary to the full exercise of citizenship, and a fundamental right enshrined by the Federal Constitution, as a typical manifestation of a democratic State of law, and the offenses towards the objective honor of Executive Heads. From this point, we seek to establish a boundary line to understand to what extent the conduct is authorized and supported by the Constitution, being able to push away the substancial adequation of a false imputation, and from which we will be facing a criminal conduct capable of generating criminal responsibility. As for the methodological aspects employed, we used the theoretical research, carried out through teaching content analysis, legislation jurisprudence, including bibliographic review and documental research. We seek to develop a deductive reasoning, so that once the general assumptions have been fixed, we can achieve via logical-deductive procedure, the conclusions reached at the end of this work.Key-words: freedom of expression; fundamental right; honor; slander.
