To do this, it will analyze various pronouncements of Spanish courts, ending with an argumentative scheme of themEn el presente artículo se va a realizar una aproximación a los problemas jurídicos que se plantean en España en relación con la gestación por sustitución. Con este fin se va a abordar, en primer lugar, el tratamiento que el ordenamiento jurídico español realiza de esta figura, prestando especial atención a la situación de la mujer gestante, para posteriormente analizar una problemática concreta que se está planteando en España en relación con esta técnica reproductiva: la inscripción en el Registro Civil español, de los menores nacidos en el extranjero mediante gestación por sustitución.
