Participación ciudadana en el gobierno local: Un análisis desde la perspectiva normativa

The local sphere is the participatory space par excellence. The government closeness to citizens makes not only the existence of channels of interaction and dialogue easier, but also the starting of tools that allow the direct intervention of these citizens in the collective decisions that must be taken by the local governments in the frame of their respective competences. The legislator has been working in this line by designing the instrumental framework in which participation must be carried out. Nevertheless, the fact that this task has been performed with some misgivings has placed it within the mere area of the representative democracy. In this context the normative action of the local councils stands out significantly. They have completed the minimum legal regulation by means of the participation rules and they have adapted it for the peculiarities of their community. However, this process is not finished. Some normative reforms to make the action of instruments more flexible are necessary, especially those related to plebiscites in order to dissociate them from referendums. But it is particularly unavoidable to provide the result of the participation with effectiveness because only in this way citizens will be really involved in the exercise of their power of decision. This gives the participation a full meaning and overcomes the consolidated view of the participative democracy as an auxiliary element of the representative one.

La proximidad del gobierno local a los ciudadanos facilita la existencia de canales de interacción y diálogo, así como la puesta en marcha de instrumentos que permitan la intervención directa de estos mismos ciudadanos en las decisiones colectivas que deban ser adoptadas por los gobiernos locales, en el marco de sus respectivas competencias. En esta línea ha ido trabajando el legislador, diseñando el marco instrumental en el que debe actuarse la participación. No obstante, ha sido una labor desempeñada con muchos recelos que la ha ubicado en los estrictos márgenes de la democracia representativa. En este contexto se destaca, de forma significativa, la actuación normativa de los municipios que, a través de los reglamentos de participación, han completado la regulación mínima legal, adaptándola a las particularidades de su comunidad. No es, sin embargo, un proceso concluso. Son necesarias reformas normativas dirigidas a flexibilizar la actuación de instrumentos, especialmente de las consultas a fin de desvincularlas del referéndum.
