Summary: The article discusses the concept and distinctive characteristics of the functions of the state. With this theoretical framework, the legal functions of the Supreme Electoral Tribunal in electoral matters are examined. In addition the legislative delegation of jurisdiction which operated in favor of the General Direction of Electoral Registration and Financing of Political Parties in the process and penalties for election offenses as characterized in the new Electoral Code is outlined as a thesis. Under this premise, the inference is made as to the power of the Department to collect data containing confidential information protected under banking or tax secrecy policies in order to exercise its jurisdiction to impose penalties
