Fundamental Rights are individuals basics rights, in order to affirm the human condition itself. However, depending on the society in which they find themselves, some rights are more protectors than others, a relationship of supremacy. In this way, we sought to assert the cultural influence in the structuring of fundamental rights and the dimension on different people traditions. For the correct framework of these rights as inherent in human beings, particular issues to each society must be taken into consideration, otherwise those issues can denature the human rights itself essence. From a historical-dialectical approach, which aims to verify whether it is the legacy of cultural heritage could legitimize distinctions within idealization of fundamental rights or, rather, differences tend to alienate the universal character of these essential rights. |
