This paper aims to demonstrate the role of cooperative in Brazil, as an integral instrument of the economy capable of contributing to national development. The proposal for this is the Government intervention in the sector, as cited in the article 174 of the Federal Constitution of 1988 and update the legislative sector, considering the fact that Law No. 5.764/1971 regulating national cooperative no longer agrees with the real situation of cooperatives nowadays. Through this law wider attributions would be given to the Organization of Brazilian Cooperatives (OBC). Another step would be to untie the system of the Ministry of Agriculture, Livestock and Supply, linking to Development Ministry. However, OBC becoming stronger may grant to the cooperative indiscriminately due care, promoting cooperative education and guidance of all concerned, as well as tax and legislative guidance. Supported in this way, the sector is likely to grow and promote the equitable distribution of income. Thus creating financial and economic resources to their members and its society, improving the quality of life of this population may be a great tool to boost the fundamental aim of the State as cited in the article 3, III, of the Federal Constitution: The eradication of poverty and to reduce social and regional inequalities.

A proposta para tanto é a intervenção do Estado no cooperativismo, conforme prevê o art. 174 da Constituição Federal de 1988, e a atualização legislativa do setor, considerando o fato de que a Lei nº 5.764/1971 que regulamenta o cooperativismo nacional não estar mais de acordo com a real situação das cooperativas na atualidade. Por meio da referida lei se estabeleceriam mais atribuições à Organização das Cooperativas Brasileiras (OCB). Outro passo seria a desvinculação do sistema do Ministério da Agricultura, Pecuária e Abastecimento, vinculando-se ao Ministério do Desenvolvimento. Assim, a OCB, mais fortalecida, poderá outorgar aos cooperados e às cooperativas de modo indiscriminado o atendimento devido, promovendo a educação cooperativista e a orientação de todos os envolvidos, além de orientação tributária e legislativa.
