This article deals with human rights and criminology, as the foundation of an effective crime policy for the prevention, control and reduction of crime plaguing our reality of insecurity and floods daily life, highlighting the failure of the state's objectives. The study objectives are to demonstrate the need for human rights are the source of criminology; check that the constitutional criminological program has no reflection in reality, in which it is privileged by revenge the damage done by the offense; reiterate that education is the only instrument capable of transforming man and, consequently, to society for social control either horizontally or vertically and not authoritarian; and insist on what the author has expressed in several of his essays about the criminological policy that currently exists is predominantly criminal and therefore insuitable to address criminality in destabilizing growing trend. The above conclusions the author are that the only solution to the critical problem of crime that seriously affects us in Peruvian society is to design an effective criminological policy which should address the structural roots of the problem, which is necessary use of criminological science rather than criminal law, not to lose time in punishing unreasonably losing a historic opportunity to re-educate the man; and it must be programmed teaching criminology and human rights from initial education to higher education in order to gradually form a social group members in the construction of private and public ethics compatible with human dignity. |
