Thus, new types of electronic and open government are being used in Brazil and worldwide. However, the question is: in the face of political and legal dimensions of sustainability, sustainable are these models? The objectives of this article are, through the analysis of two models of government and the concept of Juarez Freitas said about the dimension of sustainability, pointing out their (in) sustainabilities. For this, we used the method of dialectical approach and technique literature. We conclude that electronic and open governments do not stand alone, with serious gaps to build the political and legal sustainability regardless.A inserção de novas tecnologias de informação e comunicação na sociedade não passou despercebida por governos, que iniciaram a utilização dessas para aproximar-se do cidadão. Assim, os novos modelos de governo, o eletrônico e o aberto, estão sendo utilizados no Brasil e no mundo. Entretanto, questiona-se: diante da dimensão jurídico-política da sustentabilidade, são estes modelos sustentáveis? Os objetivos deste artigo são, por meio da análise dos dois modelos de governo e da conceituação de Juarez Freitas acerca da dimensão jurídico-política da sustentabilidade, apontar suas (in)sustentabilidades. Para isso, utilizou-se do método de abordagem dialético e da técnica de pesquisa bibliográfica.
