This reflective essay on Colombian military operations and Human Rights leverages as reference the recommendations issued by the Commission (Inter-American Commission on Human Rights or I.A.C.H.R) between 2008 and 2010 to analyze the impact on military operations from protecting Human Rights. The Commission is an organization that promotes and protects Human Rights. The recommendations issued to Colombia stem from claims submitted to the Commission for alleged violations of fundamental Human Rights by State agents against the civilian population during interim non-systemic situations. While the recommendations are not binding, Colombia has taken legislative actions and implemented policies to promote Human Rights within State agencies. It is important to point out that the recommendations from those years refer to methods employed by Military Forces in the course of Military Operations, methods resulting in violations of Human Rights on persons protected by International Humanitarian Law (IHL) such as individuals who have deposed weapons and have attempted to return to civil society, minors and civilian population. The conclusion of the analysis is that abiding to the recommendations resulted in positive outcomes for Colombia. By acting on the recommendations, Colombia preempted cases from being heard by the Inter-American Court of Human Rights (Co.I.D.H.) which would have resulted in International responsibility as offending state. In addition, Colombian Military Forces gained institutional legitimacy. Finally, it generated buy in within the military establishment about the importance of always respecting, protecting and guaranteeing Human Rights as a fundamental element of its constitutional mission in alignment with the government’s strategic objectives despite confronting the exceptional circumstances imposed by a non-international armed conflict.

Las recomendaciones de la Comisión hechas a Colombia y que provienen de un organismo protector de Derechos Humanos, a través de un informe objetivo, surgen de situaciones coyunturales, donde se presume la posible vulneración de derechos fundamentales por parten de agentes estatales en contra de la población civil, y que han sido denunciados ante la misma Comisión. Hay que mencionar, además, que a pesar de que las recomendaciones no son de obligatorio cumplimiento para el Estado colombiano, se han tomado medidas legales y políticas para implementar al interior de las instituciones estatales. También cabe señalar que las recomendaciones de estos años, refieren a los métodos empleados por las Fuerzas Militares en el desarrollo de las operaciones militares, los cuales generan una vulneración de los derechos fundamentales de las personas protegidas por el Derecho Internacional Humanitario, como lo son las personas que han dejado sus armas y se han reintegrado a la sociedad, niños, niñas, adolescentes y la población civil.
