Hermenêutica e decisão judicial: Em busca de respostas adequadas à constituição

This paper analyzes the theory of judicial decision in the light of Critical Hermeneutics of law developed in Brazil by Professor Lenio Luiz Streck. The questioning is due to the need to build and discuss a theory of judicial decision to avoid judgments activists and arbitrary.
