Differently, the realistic Ross theory is independent of the validity criterion and he argues that the effectiveness is verifiable by the effective application of the law by legal authorities.O positivismo jurídico pauta o Direito na validade formal. No entanto, a teoria do Direito também se debruça sobre outros aspectos mais próximos da empiria para compreender o fenômeno jurídico, busca-se tais elementos nas obras de Herbert Hart e Alf Ross. Para Hart, o conteúdo da regra de reconhecimento, usada para se encontrar a validade de uma norma, deve ser aferido empiricamente em cada sistema jurídico, podendo inclusive (mas não necessariamente) incorporar elementos morais.
