However, once special characteristics of the notarial function be attended, a concurrence (cluster) od responsibilities arise.El presente artículo pretende demostrar que las instrucciones notariales obligan no solo al notario con quien se celebraron sino, también, a quien lo reemplace, y que el fundamento de ello es el art. 402 del Código Orgánico de Tribunales. Asimismo, se intenta demostrar que, como consecuencia de esa extensión de obligaciones, ante un incumplimiento o cumplimiento imperfecto de las instrucciones, se genera responsabilidad civil para el notario incumplidor, cualquiera sea su clase, la que se regirá en principio por el estatuto contractual.
