After presenting the process of secularization – which has deeply marked Western societies – and the “secularization thesis”, we discuss the question of the vitality of religion in the public sphere of the post-secular age. The aim of the essay is to show the religious roots of Western Law, as based on Habermas’ thought (the theoretical reference). We also seek to show the implications these roots have for the public sphere. In conclusion, we argue that post-secularity, in Habermas’ view, means precisely to recognize the presence and importance of religion. The methodology we have applied is analytic-critical.Keywords: law, secularization, religion, Habermas, post-secularization.Este artigo trata da questão da religião na sociedade pós-secular, em Jürgen Habermas. Apresentados o processo de secularização – que marca profundamente sociedades ocidentais – e a “tese da secularização”, aborda-se a questão da vitalidade da religião no espaço público da era pós-secular. O objeto do artigo é mostrar as raízes religiosas do direito ocidental, partindo-se do pensamento de Habermas (referencial teórico), e as implicações disso para a esfera pública. Conclui-se que a pós-secularidade, na versão habermasiana, significa exatamente reconhecer a presença e a importância da religião.
