It is carried out from the analysis of criminal principles established in the paraguayan Constitution, international instruments and their reception in criminal law, in order to verify its validity in procedures involving juvenile offenders.The goal of this work is not give answers to the several questions, it focuses on emphasize the importance of the recognition and the application of the constitutional principles of criminal law in juvenile penal procedures in order to promote the effective protection of their fundamental rights.La autora expone los fundamentos del derecho penal juvenil y efectúa una revisión crítica de la legislación penal juvenil paraguaya con la finalidad de determinar su coherencia con la tutela de los derechos y libertades en el orden constitucional. A partir del análisis de los principios penales contenidos en la Constitución del Paraguay, los instrumentos internacionales y su recepción en la legislación penal, busca verificar su vigencia en los procesos que involucran a adolescentes infractores.
