The main differences between the two authors are, firstly, the disjunction dualism-monism to explain the nature of international law and state law, and secondly, his position on sovereignty concept. Our thesis is that Kelsen’s legal theory, which strongly affects the current European Community Law development, implies negative consequences for the effectiveness of Fundamental Rights and Democracy. Therefore, we propose a rereading of Hermann Heller in order to overcome the current crisis being experienced by the European Union. A propósito de cumplirse 80 años de la muerte de Hermann Heller y 40 años de la muerte de Hans Kelsen, este estudio aborda las contrapuestas teorías jurídicas de ambos autores, y cómo estas dan lugar a diferentes posturas metodológicas para el estudio y la práctica del Derecho Comunitario europeo, especialmente por lo que a Derechos Fundamentales se refiere. Las principales discrepancias entre ambos autores son, por un lado, la disyunción dualismo-monismo para explicar la naturaleza del Derecho Internacional y el Derecho estatal y, por otro, la a toma de postura en torno al concepto de soberanía. Nuestra tesis es que la teoría jurídica kelseniana, que tanto influye el el Derecho Comunitario europeo actual, implica consecuencias negativas para la efectividad de los Derechos Fundamentales y la Democracia.
