The proportions of the female delinquency had always been, throughout history, of a lesser extent than the masculine. It is easy to have access to studies about masculine delinquency; however, it is far more complicated to find investigations about female delinquents, and even more, from the gender perspective. Considering that, appears the difficulty of discerning if the risk/protection factors that have influence in the illegal behavior of the men are the same that influence in the female delinquency. It is because of this reason that it would be interesting to make a reflexion about the possibility of the woman being an active subject of the delinquency that takes place within the familiar sphere, a fact that, although it is unconnected to the purpose of the last reform of the Penal Code about the topic –Organic Law 1/2004, of gender violence-, it was taken into account in the articles of the Code, where the legislator never dismissed the possibility of a female author behind all the maltreat behaviors. We are still maintaining an unequal society in which, although in a lesser proportion, women are still submitted to men, a fact that is contributed by a series of stereotypes and roles that place women in the epicenter of a greater social control and the traditional male dominance. This gender inequality is even transferred to the inside of prisons, spaces that are a reflection of the society and where these inequalities are even increased.

Resulta sencillo acceder a estudios sobre la delincuencia masculina, siendo, sin embargo, más complicado encontrar investigaciones sobre mujeres delincuentes, y más, aún, desde la perspectiva de género. Ante ello, surge la dificultad de discernir si los factores de riesgo/protección que influyen en la conducta antijurídica de los hombres van a ser los mismos que inciden en la delincuencia femenina. Es por ello interesante una reflexión sobre la posibilidad de que sea la mujer el sujeto activo de la delincuencia que tiene lugar en el ámbito familiar, hecho, que si bien, ajeno a la intencionalidad de la última reforma del Código Penal en la materia –Ley Orgánica 1/2004, de violencia de género-, se encontraba ya prevista en el articulado del Código, donde el legislador nunca desdeñó la posibilidad de que todas las conductas relativas al maltrato pudieran tener un autor femenino. Seguimos manteniendo una sociedad desigual en la que, si bien en un camino descendente, la mujer sigue sometida al hombre, a lo que colabora un conjunto de estereotipos y de roles que sitúan a la mujer en el epicentro de un mayor control social y de la tradicional dominación masculina.
