Laburpena: The proportions of the female delinquency had always been, throughout history, of a lesser extent than the masculine. It is easy to have access to studies about masculine delinquency; however, it is far more complicated to find investigations about female delinquents, and even more, from the gender perspective. Considering that, appears the difficulty of discerning if the risk/protection factors that have influence in the illegal behavior of the men are the same that influence in the female delinquency. It is because of this reason that it would be interesting to make a reflexion about the possibility of the woman being an active subject of the delinquency that takes place within the familiar sphere, a fact that, although it is unconnected to the purpose of the last reform of the Penal Code about the topic –Organic Law 1/2004, of gender violence-, it was taken into account in the articles of the Code, where the legislator never dismissed the possibility of a female author behind all the maltreat behaviors. We are still maintaining an unequal society in which, although in a lesser proportion, women are still submitted to men, a fact that is contributed by a series of stereotypes and roles that place women in the epicenter of a greater social control and the traditional male dominance. This gender inequality is even transferred to the inside of prisons, spaces that are a reflection of the society and where these inequalities are even increased.
