The international system today faces the increasing phenomenon of vulnerable States, which has generated an important amount of documents and bibliography within many of the Social Sciences. However, it lacks of an interdisciplinary approach based on International Relations and International Law. This articles aims to check to what extent this phenomenon has a universal impact, regardless of the material peculiarities that might exist in the various regional subsystems. We also carry out a rigorous and comprehensive analysis of the situations in place, thanks to the integration of legal criteria both in its description and definition. In particular, the official sources of the institutional structure of the international order will be indispensable in obtaining direct information of good quality. A very simple typology is proposed, which considers two ideal types: the fragile and the failed States, providing details on their similarities and differences, but also about their causes and characteristics. From the perspective of International Law, the key element to define a failed State is its incapacity to comply with its obligations, internally (ad intra) and, above all, internationally (ad extra). But the international system does not consider the possibility of the extinction of any State in cases of extreme failure. So far, the international order has
watched over and protected these States without even raising the issue of their identity and continuity as subjects of International Law, thus securing their sovereignty and territorial integrity through the unrestricted implementation of the structural principles of International Law. This practice shows a clear will in this regard and, despite the legal virtuality of
a failed State, dogmatic and formal doubts cannot but be rebuffed.

Ce phénomène a suscité une abondante documentation et bibliographie dans le cadre de diverses sciences sociales. Mais il manque une approche interdisciplinaire, sous l'angle des Relations Internationales et du Droit International. L'objectif est de vérifier l'ampleur universelle du phénomène, malgré les spécificités matérielles qu'il présente dans les différents sous-systèmes régionaux. Il faut aussi mener une analyse plus rigoureuse et compréhensive des situations en présence, grâce à l'incorporation de critères normatifs, tant dans sa description que dans définition. En particulier, les sources officielles provenant la structure institutionnelle internationale sont d'une grande utilité pour obtenir une information directe et de qualité sur ce phénomène. Nous proposons une typologie simple qui se limite à distinguer deux types idéaux: l'État faible et l'État failli, tout en détaillant les différences et ressemblances entre les deux, en plus de leurs causes et caractéristiques. Pour le droit international l'élément clef du concept d'Etat failli est son incapacité de satisfaire ses obligations dans l'ordre interne (ad intra) et surtout internationalement (ad extra). Mais le système international ne considère pas la possibilité de la disparation d'un État en cas d'extrême faillite. Jusqu'à maintenant, l'ordre international a pris sous sa tutelle ces États sans mettre en doute leur identité et continuité comme sujets du Droit International, en appliquant sans restriction les principes fondamentaux qui garantissent leur souveraineté et intégrité territoriale, entre autres droits. Face à cette pratique, qui exprime une volonté claire du système, tous les doutes dogmatiques ou formels concernant la virtualité juridique de l'État failli ne peuvent que s'effacer.El sistema internacional se enfrenta hoy al fenómeno de la proliferación de Estados vulnerables, que ha generado una abundante documentación y bibliografía procedente de distintas ciencias sociales. Pero se echa en falta una aproximación interdisciplinar fundada en las relaciones internacionales y el Derecho internacional. El objetivo es comprobar que el fenómeno posee un alcance universal, al margen de las peculiaridades materiales que presente en uno u otro subsistema regional; y realizar un análisis más riguroso y comprensivo de las situaciones en presencia, gracias a la incorporación de criterios normativos para su descripción y definición. En particular, el uso de las fuentes de conocimiento oficiales que emanan de la estructura institucional de este ordenamiento es imprescindible para obtener información directa y de calidad sobre este tema. Se propone una tipología de situaciones muy sencilla que se limita a distinguir entre dos tipos ideales, el Estado débil y el Estado fracasado, detallando las similitudes y diferencias entre ambos, así como sus causas y caracteres principales. Para el Derecho internacional, el elemento clave del concepto de Estado fracasado es su incapacidad para cumplir las funciones del Estado en el orden interno (ad intra) pero sobre todo en el orden internacional (ad extra). Pero no considera la posibilidad de la extinción del Estado como consecuencia de una situación de fracaso extremo. Hasta ahora, el ordenamiento internacional ha tutelado a los Estados fracasados sin poner en duda su identidad y continuidad como sujetos del DI, aplicándoles sin restricción los principios estructurales que garantizan su soberanía e integridad territorial y otros derechos.
