On the other hand, basic rights are analyzed from the material point of view with their influence over the realisation of social rights, in order to allow us, therefore, to propose concrete conclusions.El artículo pretende plantear, desde la teoría jurídica, un fundamento de los derechos sociales, y enmarcarlos en el contexto constitucional colombiano, de manera que avancemos hacia el reconocimiento de que los derechos sociales son de obligatorio cumplimiento para todos los poderes y dignos de protección judicial.Se abordan, en primer término, los derechos fundamentales desde el punto de vista formal y sus implicaciones frente a los derechos sociales, y se examina el ordenamiento constitucional colombiano.
