The Law has swiftly been adopted bearing in mind that an amendment to Directive 2011/92 (environmental assessment of projects) was under discussion at European Union level. The new Law includes a range of problematic aspects, such as the definition of the projects subject to assessment, the various procedural stages and the amendments to existing environmental reports, prepared by the so-called environmental authority in the case of plans and programmes, but not subject to time-frames.El presente trabajo analiza la Ley 21/2013, de evaluación ambiental. Esta Ley deroga la normativa anterior y unifica de diversas maneras el régimen jurídico aplicable a los planes y proyectos. La Ley se ha adoptado de manera expeditiva cuando en el ámbito de la Unión Europea se estaba debatiendo la modificación de la Directiva 2011/92, relativa a los proyectos de construcción. El nuevo texto plantea diversos problemas respecto de la definición de los proyectos sujetos, los trámites procedimentales y también la posible modificación de las declaraciones de impacto relativas a los planes, sin sujeción a elementales límites temporales.
