Summary: This article seeks to determine whether Colombia’s National Television Authority is a state agency that is independent from the central government and whether it possesses the institutional guarantees to independently perform its functions. To accomplish this objective, this work looks at the institutional design that spurred the 1991 Constitution, which removed television as a public service as well as the state authority in charge of its regulation. This piece then studies the scope of statutes, laws and regulations that were issued following the 2011 Constitutional reform, which distributed the work of Colombia’s now extinct National Television Commission to different entities, such as the recently created National Television Authority.
