Summary: In the most recent jurisprudence concerning regulation of public utilities, in this paper it is discussed some of the author’s ideas related to specific aspects which he believes are the bases of the legal – administrative review on the subject; the clarity of those aspects would help the better development of a technique of State intervention in the economy, as well as having enormous impact in this area. In this respect, and with the understanding that regulation is not a legal instrument, but uses tools of this discipline for its development, the author puts forward some reflections about the limits and synergies between the regulation and the “reglamento”, and the consequential distinction that it turns out with the legislative function; then, dwell on the analysis of nature “not administrative” of some functions of the regulatory commissions of public utilities, and proximity of these functions with others typically categorized as judicial.
