Summary: Regulatory administrative actions have an exceptional degree of ambiguity, which has to be counterbalanced with a specific legal framework. A clear legal definition of the general interest and a detailed motivation by the administration on the proportionality of the obligations to be imposed, would allow for more efficient jurisdictional control of all administrative regulatory activity. By doing this, legal certainty and the protection of companies and users’ rights would be reinforced.
