While the problems raised is far-reaching and undergoes a horizontal approach along different areas of law, the truth is that the child�s return has been regulated by international and supranational instruments that have managed to provide it with efficiency. Indeed, both the Hague Convention of 1980, primarily, as Regulation 2201/2003, additionally to the intra-EU situations, have shaped this figure whose basic and fundamental objective is the protection of interests of the child. At the level of the European Union with a series of elements introduced that regulation seeking to improve its regulation and posing as historical fact the first time that the elimination of exequatur for certain decisions in this area is allowed.El presente trabajo analiza el instrumento más eficaz que existe actualmente en la sustracción internacional de menores: la orden de retorno inmediato del menor. Si bien la problemática suscitada es de largo alcance y experimenta un tratamiento transversal a lo largo de diferentes ámbitos del ordenamiento jurídico, lo cierto es que el retorno del menor se ha regulado a través de instrumentos internacionales y supranacionales que han conseguido dotarle de eficacia. Efectivamente, tanto el Convenio de la Haya de 1980, con carácter principal, como el Reglamento 2201/2003, con carácter complementario para las situaciones intracomunitarias, han perfilado esta figura que tiene como objetivo básico y fundamental la protección del interés superior del menor.
