Summary: The purpose of this work is to explore and analyze the possibility of applying emerging environmental management instruments to reverse the situation of the degradation of the elements of the environment as a result of events occurring in the past, and in relation to which previous environmental responsibility systems do not offer an answer, like land stewardship, always in the framework of the principles of participation, co-responsibility, polluter pays, no regression and intergenerational solidarity in environmental matters. The involvement of the owners of contaminated soils in the restoration and maintenance of sustainable uses of the decontaminated soil would constitute a breakthrough in this field, in which the laws of environmental responsibility and contaminated soils do not offer a satisfactory answer. The U.S. Farm Bill could serve as a model for the design and implementation of this new approach.
