It describes and analyzes the difficulties and challenges of the implementation of social rights in South America with the aim of building a regional constitutionalism whose foundation is the ius commune. For this purpose, the article presents the historical background of the affirmation of human rights and social rights as well as structural notions of the systems of their protection both at the global level and regional level in order to provide within the latter, especially in the South America, the challenges of the ius commune.Key words: ius commune, social rights, South-American region.O presente artigo científico possui como escopo principal o estudo dos direitos sociais, com enfoque na proteção destes nos contextos internacional e regional interamericano. Desta feita, almeja-se, de maneira breve, expor e analisar as dificuldades e os desafios da efetivação dos direitos sociais na América do Sul, em que se vise à construção e pavimentação de um constitucionalismo regional cuja base seja o “ius commune”.
