In 2012, the European Court of Human Rights issued its judgment in the case of Hirsi Jamaa and others versus Italy and found a violation of Article 3 ECHR (torture or inhuman or degrading treatment or punishment prohibition) and of the article
4 of Protocol No.4 (collective expulsion of aliens). The applicants, eleven Somali national and thirteen Eritrean nationals were intercepted by three ships from the Italian Revenue and were handed over to the Libyan authorities. They alleged violation of Article 3 of the Convention on account of applicants having been exposed to the risk of inhuman and degrading treatment in Libya and on account of the fact that the applicants were exposed to the risk of arbitrary repatriation to Eritrea and Somalia. They stated that they had been the subject of a collective expulsion having no basis in law and in violation of article of Protocol No 4. The present case is very important because it is the first time that the Court condemns a State for a removal of aliens carried out in the context of interceptions of the high seas.

The present case is very important because it is the first time that the Court condemns a State for a removal of aliens carried out in the context of interceptions of the high seas.En 2012, el Tribunal Europeo de derechos humanos emitió su fallo en el caso Hirsi Jamaa y otros contra Italia en el que constataba la violación del artículo 3 del CEDH (tortura y penas o tratos inhumanos, crueles y degradantes) y del artículo 4 del Protocolo nº 4 al CEDH (expulsión colectiva de extranjeros). Los demandantes eran veinticuatro inmigrantes ilegales de origen somalí y eritreo que, cerca de las costas de Malta, fueron interceptados por un buque guardacostas italiano y dirigidos a costas libias, donde son entregados a las autoridades de este país. Ante tales hechos, los demandantes entienden que el gobierno italiano ha vulnerado los dos preceptos mencionados supra. Por una parte, consideran que el hecho de ser entregado a Libia sin haberse interesado por la situación particular de cada uno de ellos constituye violación del artículo 4 del Protocolo nº 4. Además, entienden que el hecho de ser entregados a Libia, país que no respeta los estándares en materia de derechos humanos y en el que los inmigrantes irregulares son sometidos a condiciones inhumanas constituye violación del artículo 3. Asimismo, entienden que, una vez entregados a Libia, el riesgo de ser devueltos a sus países de origen, en los que la situación de los derechos humanos es nefasta, sin ningún tipo de garantía constituye también violación del artículo 3.
