Summary: This study analyzes the regulatory community and national start-up in order to protect the consumer of electrical service and the need for EU Members to take measures to combat the "energy poverty" in the framework of the process of liberalization of the electrical sector. The delivery to the market of this economic activity has been done while safeguarding the public interest that lies behind it. For this purpose the obligations that EU law imposes on Member States are dealt to ensure the domestic consumer the right to an electrical supply of quality and at a reasonable price - as universal service - and the need to adopt measures to protect the vulnerable consumer and fight against the "energy poverty"; as well as the optional character which the European Union grants the electrical companies the establishment of "public service obligations". Besides this, we expose the weaknesses detected in the transposition from EU regulation to the Spanish domestic Law and the proposals for improvement.
