It shows the lack of a minimally shared position amongst the authors and analyses the dangers of a negative answer to the question formulated and also the comparative law on this subject. The author defends the thesis that, given certain conditions �which are analyzed�, it cannot be concluded that the binding effects of the constitutional rulings on the legislator prevent him from reiterating the provisions declared unconstitutional. The case of the Statute of Autonomy of Catalonia of 2006 serves as a contrast to the discussion contained in the work.En este Trabajo se analizan los efectos vinculantes de las sentencies del Tribunal Constitucional sobre los poderes públicos y, más concretamente, si el legislador puede legítimamente reiterar preceptos legales declarados inconstitucionales. Se constata la ausencia de una posición doctrinal mínimamente compartida al respecto; se analizan los peligros que comporta una negativa radical a la pregunta formulada, así como el derecho comparado sobre la materia. El autor defiende la tesis de que, dadas determinadas circunstancias, que se analizan, por las razones que se exponen no puede concluirse que los efectos vinculantes de las sentencias constitucionales lleven a afirmar que el legislador no puede reiterar los preceptos declarados inconstitucionales.
