Summary: This article analyses the new constitutional procedures, known as recurso y cuestión [literarily: appeal and question].These were created under Constitutional Act 1/2010, 19th February, amending the constitutional acts on the Constitutional Court and the Judiciary that had granted the Constitutional Court control over the fiscal regulations devolved to the Historic Territories of the Basque Country as an autonomous region (normas forales). The Act not only created these procedures by also excluded the contentious- administrative jurisdiction from the fiscalisation of these regulations despite their infra-legal status. The article touches upon the most important problems arising with this legislative reform and points to possible solutions. It considers it to have significant influence over the configuration of the Spanish system of constitutional justice.
