Summary: The projection of Community Law over the internal legal order is a projection that covers that national substantive sphere which is delimited by the powers attributed to the Communities and which is articulated through the national application of Community provisions. However, sometimes, Community Law does affect the internal sphere delimited by powers which were not transferred to the Communities, and so it is a sphere which a priori is meant to be outside the scope of Community Law. This ultra vires influence of Community Law can be produced by means of different ways or channels, among which it is the protection to equal treatment. This article deals with the description of this sort of communitarizing influence that the protection of the principle of equality produces in that part of domestic legal order which is beyond the application of the Community Law. That influence lies in compelling States to recognize or accept a series of normative contents set up by Community law, in special subjective rights.
